Ive founds the barbs flute but I cannot return it is this a glitch?

Don't know, haven't done that mission yet. I know own the Emporer's Flute and Lute. Just saying, if you are going to be a bard, have the best equpment! LOL

You can not really GET the Emporer's instruments, I just picked them up in his cabin when I killed him.

It's one of many bugged quests in the game. If you find the flute before you receive the quest then you cant hand it in. I'm afraid it's one of many examples of carelesss and lazy programming that Skyrim is plagued by. That and the total lack of playtesting before they released the game.
