mercer theives guild

I have encountered a huge problem, when I go to talk to mercer at the thieges guild all he does is say something about bothering him and I can never talk to him for the quest, I'm playing on 360 so am I Jus screwed? Is there a way to reset him? I've tryed fighting him but he won't die he just kneels and then gets back up, anyone else had this problem? Any help will be greatly appreciated.
