Quest Imitation Amnesty without being thane?

Anyone have tips for doing Imitation Amnesty without being the Thane of Whiterun? I'm on PS3 so no consoles. My issue is the little kids, they're always sitting on the bench in the Jarl's Quarters. I've tried multiple times and different hours - they're always there.

After about a dozen failed attempts I ran past the kid even though he was yelling, theres a balcony thats considered Whiterun. I got to that then went back in from behind the kid.
