AFAIK orc takes half damage from both magic and weapons, so for the defensive part it's 25% magic resist all the time, vs. 50% magic and physical resist for 60 sec a day (a fight usually). I personally don't feel the lack of magic resist in most fights, except vs dragons and/or 'bosses'. And I...
Haven't tried all specific builds (no dagger assassin yet) so can't give a definitive answer, but so far my most damaging build has been dual wield (swords) orc using the attack speed shout.
It doesn't bother me, for these exact reasons. It's a single player game, where you're not competing with anyone. I simply noticed it and was curious how other people feel about it.

Maces. Seriously, ignore 75% armor is probably the best spec you can get.
Also, heavy armor tree gives you access to better weapons, so I suggest heavy armor.

Tested it with empty inventory. Still the same, from what I could gather, it's a temp health bonus not removing properly. Sometimes it goes away on it's own.
There is a cap on the damage reduction (80% or 85%) you can get from armor. You reach it at 567 armor (I think). Any further increase in armor after that does nothing.
